Terms and conditions of sale
1. Purpose and seller
These terms govern the sale of the products EUROPE TECHNOLOGIE presented on this site: Record (the analysis and its documents), the Restore option (the reinstatement), Watch (the watch) and Watch Fleet (the watch by seats, for a fleet of sites). The seller is EUROPE TECHNOLOGIE, Entreprise individuelle (EI), 133 avenue Gambetta, 75020 Paris, France, SIRET 532 321 973 00036.
2. Prices and taxes
Prices are shown in euros. VAT not applicable — VAT exemption under Article 293 B of the French General Tax Code : no VAT is charged, and the amounts displayed are the amounts you pay.
3. What we sell, and the scope of our promises
Our tools analyse a site’s files and what that site serves publicly. For each executable file inventoried, they establish whether or not it can account for its presence.
We do not promise to detect every possible intrusion, and we never use the word “safe”. A site in which every file is accounted for may nonetheless contain a known vulnerability, a compromised database or a stolen password. The limits of each analysis are set out in the report and in the signed documents, on their front page.
4. Authorisation to analyse
By launching an analysis, you declare that you are the owner of the site being analysed or that you hold written authorisation from its owner. Analysing a server-side site also requires a token that only someone with access to the server can read, which makes analysing a third-party site materially impossible without their consent.
5. Payment and delivery
Payment is made online by card, via Stripe (Stripe Payments Europe, Ltd.): no card data passes through our servers. The analysis is a service performed immediately after payment. The findings, the document intended for your host and the signed proof are delivered electronically, on the analysis page itself, as soon as the analysis is complete.
6. Right of withdrawal
The analysis is a service fully performed as soon as it is launched, with your express consent: under Article L221-28 of the French Consumer Code, the right of withdrawal no longer applies once the analysis has been performed.
If the analysis cannot be performed, or if the announced documents are not delivered to you, the amount is refunded in full to the payment method used. Write to contact@aiwebsitesecurity.com stating the domain concerned.
7. Watch and Watch Fleet
Monitoring is sold for a term ofone year, paid in a single payment. This is not a subscription: nothing renews automatically, no further charge is made, and there is nothing to cancel. At the end of the year, monitoring stops of its own accord and you are notified by email. Resuming it is a new purchase, never an automatic renewal.
To stop before the end of the term: a stop link is included in the welcome email for your monitoring — two clicks are enough, with no justification required and at no cost. You can also write to contact@aiwebsitesecurity.com stating the monitored domain: the termination is then recorded the same day. Early termination does not entitle you to a refund of the remaining period, except in the case of the right of withdrawal (article 6) and of failure to perform on our part, which is refunded in full.
Monitoring begins as soon as its agent is set up, with your express consent obtained at the time of payment. If you exercise your right of withdrawal within fourteen days, the portion corresponding to the service already provided is retained pro rata to the days elapsed, in accordance with article L221-25 of the French Consumer Code; the remainder is refunded to the payment method used.
Watch Fleet is that same watch, sold by seats: a fleet of 5, 10, 25 or 50 seats, settled in a single payment for one year, with every seat falling due on the same date — that of the payment. A seat is one site under watch. A site taken out of the fleet frees its seat, which may be assigned to another site during the current year.
Stopping early is done site by site, as with Watch, and does not give rise to a pro rata refund of the remaining period, apart from the right of withdrawal (article L221-25 of the French Consumer Code, on the terms set out above) and apart from a failure to perform on our part, which is refunded in full. A weekly summary of the state of the fleet is sent to the contact declared at sign-up.
8. Liability
Our tools operate in read-only mode for the analysis. When a restoration operation is requested, each action is verified afterwards and automatically rolled back if its effect is not observed.
We recommend that you have a recent backup before any intervention on a site. We cannot be held liable for the indirect consequences of an intrusion that our tools failed to reveal, within the limits set out in article 3.
9. Applicable law
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action.
